The problem with our Presidential Elections and Vice Presidential elections is that we are not following Amendment 12 exactly as written. Instead, what we are following is the Electoral Counting Act of 1887. The Electoral Counting Act of 1887 -- and any subsequent updates -- never went through the Amendment process. But Amendment 12 clearly did. Furthermore, no state laws like "a popular vote, " " winner take all, " or laws forcing the electors of our states to "pledge" their votes to certain candidates never went through the Amendment process either! The election of 1876 (which inspired the Electoral Counting Actof 1887 in the first place! ) was a mess because they were trying to add a popular vote in the states then when they weren't supposed to. Our forefathers, like George Washington, did not want a popular vote for the elections of President and Vice President. They wanted the Electors of our states to do all the voting. The real system is rig-proof and trouble-proof. It creates an election "day" --- not an election "month" or "year! ". There is a popular vote for Senators and Representatives in our states. But we are clearly NOT allowed to vote for Presidents and Vice Presidents. The end!!!!
